A Prenuptial Agreement (often called a Prenup or Premarital Agreement) is a written contract entered into by people intending to marry which commonly includes provisions for division of property and spousal support in the event of divorce or breakup of marriage.
Traditionally Prenuptial Agreements were most often used by the rich where one person was significantly wealthier than the other in order to protect their assets. Today, in an era when many couples may have two or three marriages with children from previous marriages, it is often used to assure that property is disbursed among a spouse’s children in the event of an unexpected death when a will or trust is not in place.
A Prenuptial Agreement is definitely not a project for anyone but an experienced divorce attorney so that you may decide yourself how your property may be handled. Only a highly experienced attorney can draft a Prenuptial Agreement as such agreements are very technical in nature and contain numerous requirements before they could be considered a valid contract.

The wealthy are not the only individuals that can benefit from such an agreement. Those that are married later in life after having accumulated even a modest amount of wealth can take advantage of such an agreement. Those that remarry and/or have children from previous relationships should also strongly consider a Prenuptial Agreement.
