In a divorce the most important issues are where a child lives (physical custody) and who makes the decisions about the child’s education, medical care and religious upbringing (legal custody).
It is very important that the parents cooperate in drafting a custodial agreement that outlines the exact days and times each parent will have custody of the child. The parents must ensure that the agreement includes the timeshare on weekdays, weekends and all holidays.
If the parents cannot agree then a judge may decide the custodial arrangement. Judges always prefer that parents cooperate but if they do not then a judge will place them where the child’s best interests are served.
It is always better for parents to take control over their child and decide for themselves where the child will live and attend school. It is our policy to encourage parents to decide where a child lives and not allow a stranger (which a judge is) to make that decision.
